Comments Dear Governmental Agency
Pursuant to your states public records law, we request that your agency
supply us with the following:
All records, which identify dollars that you are holding on accounts that are
owed to citizens, company, and/or corporations. This list may be called, but
not limited to Unclaimed Funds, Open items, Open warrant list, Check
Reconciliation list. We are interested in Tax lien surplus, Tax lien
overpayments, Mortgage Foreclosure Proceeds, Mortgage Foreclosure Overage, or
Foreclosures surplus balances sheets. We ask that this information include
payee’s name, last known address, dollar amount owed. Check number, and all
other information that identifies the payee. Please include property tax
overpayment in this list. If possible please only show dollar amount greater
Under your states public records law all public records shall be promptly
prepared and made available for inspection to any person at all reasonable
times during regular business hours. Upon request, a person responsible for
public records shall make copies available at cost, within a reasonable
period. The Privacy Act does not restrict access to records that are public.
Unless made confidential by law, all records maintained by a governmental
agency that is necessary to the agency’s execution of its duties and
responsibilities are public records. A governmental body refusing to release
records has the burden of proving that excerpts the records from disclosure.
Please waive any applicable fees. Release of the information is in the public
interest because it will significantly contribute to public understanding of
government operations and activities.
If my request is denied in whole or part, we ask that you justify all
deletion by reference to the specific exemptions of the act. We will also
expect you to release all segregate portions of otherwise exempt material.
We, of course, reserve the right to appeal your decision to withhold
information or to deny a waiver of fees.
